Day2 Social Publisher — Terms of Service

1. Who We Are
Day2 Social Publisher (the "Service") is a social-media publishing tool operated by Day2 AI ("Day2", "we", "us"), Israel. The Service allows businesses that work with Day2 (our "Clients") to schedule and publish content — such as videos, images, and text posts — to their own social-media accounts, including TikTok, Instagram, and Facebook, through the official APIs provided by those platforms. The Service is accessible at https://postiz.day2-ai.com.
2. Acceptance of These Terms
By connecting a social-media account to the Service, authorizing the Service through a platform's OAuth flow, or otherwise using the Service, you agree to these Terms of Service and to our Privacy Policy. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these terms.
3. The Service
- The Service publishes content only to accounts you have explicitly connected and only content that you (or your authorized representatives at Day2, acting on your instructions) have provided or approved.
- Publishing is performed exclusively through the platforms' official developer APIs (e.g., the TikTok Content Posting API and the Meta Graph API), in accordance with each platform's developer terms.
- You may disconnect a social account at any time, either inside the Service or by revoking the app's access from the social platform's own security/app settings. Disconnection immediately stops any further publishing to that account.
4. Your Responsibilities
- Content ownership. You represent that you own, or hold all necessary rights and licenses to, all media and text you provide for publishing, and that publishing it does not infringe any third party's rights.
- Platform rules. Content published through the Service must comply with the terms, community guidelines, and content policies of the destination platform (e.g., TikTok Community Guidelines, Meta Platform Terms) and with applicable law.
- Prohibited content. You may not use the Service to publish content that is unlawful, deceptive, infringing, hateful, sexually exploitative, or spam, or to engage in inauthentic behavior such as artificial engagement.
- Account security. You are responsible for maintaining the security of your own social-media account credentials. The Service never asks for, and never stores, your social-media passwords — authorization is granted only via each platform's official OAuth flow.
5. Our Rights
We may suspend or terminate access to the Service, or decline to publish specific content, if we reasonably believe it violates these terms, platform policies, or applicable law. We may modify or discontinue the Service with reasonable notice to active Clients.
6. Fees
The Service is provided to Day2 Clients as part of their service agreement with Day2. Any fees are those set out in the applicable Client agreement; these Terms do not themselves impose fees.
7. Disclaimers
The Service is provided "as is" and "as available". We do not guarantee that any specific post will be accepted, published, or remain available on any third-party platform — platforms may reject, remove, or restrict content under their own policies, and their APIs may change or become unavailable. To the maximum extent permitted by law, Day2 disclaims all implied warranties, including merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, Day2 shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill, arising from the use of the Service. Day2's aggregate liability under these terms shall not exceed the amounts paid by the Client to Day2 for the Service in the twelve (12) months preceding the claim.
9. Termination
You may stop using the Service and disconnect your accounts at any time. Upon termination, we delete the access tokens associated with your connected accounts as described in our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv shall have exclusive jurisdiction, without prejudice to mandatory consumer-protection rights in your place of residence.
